‘Back to the future’: Embryonic gig worker benefit programs look like Texas injury benefit plans 30 years ago

With it comes significant interest in finding out how our modern workplace’s workers will be covered in the event of an injury or illness on the job. Uber Technologies developed its “Driver Injury Protection” program to provide insurance coverage to drivers when they are logged on to the app, and transporting passengers. The National Domestic Workers Alliance announced a portable benefits platform called Alia for domestic house cleaners. New York’s Black Car Fund has long-provided a non-profit, workers’ compensation program for drivers of taxis and limos. The programs are varied in how they define and deliver services.
“Determining who is, and who is not, an independent contractor is something that states and federal legislators, regulators and courts are working to decide,” Minick explains. “As they modernize the definition of those involved in this new working model, we will see more of these insurance products spring up for any job imaginable that can be performed by an independent contractor. While there is no doubt that the gig economy is here to stay, we stress that it is necessary to appropriately fund the full cost of that labor — and not shift the expense of work injury to charitable, governmental or other social programs funded by taxpayers.”
To create sustainable programs that work, PartnerSource and others are asking companies to look at the lessons learning in the successful Texas option. Workers covered by Texas injury benefit programs today have three large advantages over workers covered by new gig worker programs:
Alternative solutions in Texas must be ERISA-compliant. The Employee Retirement Income Security Act (ERISA) is a federal law that provides strong worker protections on reporting, full disclosure, fiduciary duties and claim procedures that (according to the U.S. Supreme Court) provide a “full and fair review” of claims;
Injured workers can sue their Texas employer for any failure in safety or training that caused the injury. The employer cannot defend against such claims based on the worker’s assumption of risk, negligence of a fellow employee, or contributory or comparative negligence; and
A 30-year track record of experimentation, refinement and success. Innovation was the genesis, but repeated testing and refinement has produced a solution that works. Simply put, in the vast majority of cases, workers get better benefits and care in a solution that ultimately also costs employers less.
